Enterprise Crisis Management
A team of specialists in the business crisis and insolvency sector is able to support the company from a legal and financial standpoint, including the following activities:
- mapping of company imbalances through economic, financial and equity analysis functional also to the implementation of the recovery process;
- preparation of recovery plans, including the identification of the causes of the crisis, the identification of the industrial corrective measures to be adopted to achieve company equilibrium and the consequent financial manoeuvre for debt restructuring;
- identification of the most suitable crisis recovery tools (such as the certified recovery plan, the debt restructuring agreements; the court-approved recovery plan and the composition with creditors);
- preparation of the documentation necessary for the request for a tax and/or social security settlement;
- possible forced extension of the effects of the agreement in the event of dissent by the financial administration (so-called tax cram down), and discussion with the officials of the competent departments for the relevant discussion and approval;
- drafting of the documentation necessary for the appointment of the expert for the negotiated settlement of the crisis and assistance in the negotiation process with the interested parties;
- negotiation of debt restructuring with creditors and possible investors.
We also provide legal assistance in insolvency proceedings (e.g., curators of receiverships, the bodies of companies in composition) or companies in negotiated composition, including investment operation, distressed M&A, arrangements and litigation.
